font-family: arial, helvetica, sans-serif; line-height: 1.3; color: #000000;\">Ou seja, <strong>terras devolutas<\/strong> s\u00e3o terras p\u00fablicas, que por n\u00e3o estarem sendo utilizadas pelo <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/pt.wikipedia.org\/wiki\/Poder_p%C3%BAblico\" target=\"_blank\" rel=\"noopener noreferrer\">poder p\u00fablico<\/a><\/span>, em nenhum momento passaram a integrar o patrim\u00f4nio de um particular, ainda que estejam irregularmente sob sua posse.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000; line-height: 1.3;\">A <strong>Lei da regulariza\u00e7\u00e3o fundi\u00e1ria rural e urbana<\/strong> traz a possibilidade da venda ou cess\u00e3o das terras devolutas para pessoas que as ocupem antes de julho de 2008 (no caso de cess\u00e3o) e antes de dezembro de 2011 (no caso de venda). <\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000; line-height: 1.3;\">Vamos entender melhor qual \u00e9 a origem das terras devolutas.<\/span><\/p>\n<h2><\/h2>\n<h2 style=\"text-align: center;\"><strong><span style=\"font-size: 24px; Al\u00e9m disso, <strong>alguns colonizadores n\u00e3o tiveram sucesso,<\/strong> sendo que as faixas de terras ocupadas pelos mesmos foram revertidas \u00e0 Coroa.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; line-height: 1.3; color: #000000;\">Ambas as situa\u00e7\u00f5es, faixas de terras n\u00e3o foram trespassadas e faixas de terras revertidas \u00e0 Coroa, <strong>constituem as terras devolutas<\/strong>.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; line-height: 1.3; color: #000000;\">Com a independ\u00eancia do Brasil, estas faixas de terras passaram a integrar o dom\u00ednio imobili\u00e1rio do estado brasileiro, englobando todas essas terras que n\u00e3o ingressaram no dom\u00ednio privado por t\u00edtulo leg\u00edtimo ou n\u00e3o receberam destina\u00e7\u00e3o p\u00fablica.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><span style=\"font-size: 24px;\"><strong><span style=\"font-family: arial, helvetica, sans-serif; padding-top: 10px; padding-bottom: 10px;\">\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">I &#8211; \u00e1reas rurais situadas em terras da Uni\u00e3o, no \u00e2mbito da Amaz\u00f4nia Legal, e em terras do Instituto Nacional de Coloniza\u00e7\u00e3o e Reforma Agr\u00e1ria &#8211; Incra;<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">II &#8211; ocupa\u00e7\u00f5es fora da Amaz\u00f4nia Legal nas \u00e1reas rurais do Incra e da Uni\u00e3o sob gest\u00e3o do Incra; e<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">III &#8211; \u00e1reas remanescentes de projetos com caracter\u00edsticas de coloniza\u00e7\u00e3o criados pelo Incra, dentro ou fora da Amaz\u00f4nia Legal, anteriormente a 10 de outubro de 1985.<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">\u00a7 1\u00ba Para fins do disposto no inciso III do caput, consideram-se projetos com caracter\u00edsticas de coloniza\u00e7\u00e3o:<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">I &#8211; projeto de coloniza\u00e7\u00e3o oficial;<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">II &#8211; projeto de assentamento r\u00e1pido;<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">III &#8211; projeto de assentamento conjunto;<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 20px; color: #000000;\">IV &#8211; projeto especial de coloniza\u00e7\u00e3o;<\/span><\/p>\n<p class=\"dou-paragraph\"><span style=\"font-family: arial, helvetica, sans-serif;
