font-family: arial, helvetica, sans-serif; color: #000000;\">Vamos analisar os principais impactos provocados por estas leis na regulariza\u00e7\u00e3o fundi\u00e1ria urbana e qual o estado da arte da mesma.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><span style=\"font-size: 24px; font-family: arial, helvetica, sans-serif; color: #000000;\">\u00a7 1<small><sup><u>o<\/u><\/sup><\/small><small><sup><u><\/u><\/sup><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small> Considera-se loteamento a subdivis\u00e3o de gleba em lotes destinados a edifica\u00e7\u00e3o, com abertura de novas vias de circula\u00e7\u00e3o, de logradouros p\u00fablicos ou prolongamento, modifica\u00e7\u00e3o ou amplia\u00e7\u00e3o das vias existentes.<\/span><\/p>\n<p class=\"p13\" align=\"justify\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">\u00a7 2<small><sup><u>o<\/u><\/sup><\/small><small><sup><u><\/u><\/sup><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small><small><u><\/u><\/small> Considera-se desmembramento a subdivis\u00e3o de gleba em lotes destinados a edifica\u00e7\u00e3o, com aproveitamento do sistema vi\u00e1rio existente, desde que n\u00e3o implique na abertura de novas vias e logradouros p\u00fablicos, nem no prolongamento, modifica\u00e7\u00e3o ou amplia\u00e7\u00e3o dos j\u00e1 existentes.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">\u00a7 4<sup><u>o<\/u><\/sup><sup><u><\/u><\/sup><u><\/u><u><\/u><u><\/u><u><\/u><u><\/u><u><\/u> Considera-se lote o terreno servido de infra-estrutura b\u00e1sica cujas dimens\u00f5es atendam aos \u00edndices urban\u00edsticos definidos pelo plano diretor ou lei municipal para a zona em que se situe. <\/span><\/p>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">Ou seja, a lei 6.766\/79 definiu os 2 diferentes tipos poss\u00edveis de parcelamento do solo urbano, definindo tamb\u00e9m as condi\u00e7\u00f5es nas quais tais parcelamentos podem ser feitos.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #000000;\">A lei do parcelamento do solo tamb\u00e9m definiu o conceito de lote, definindo que a prefeitura, atrav\u00e9s<\/span> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.politize.com.br\/plano-diretor-como-e-feito\/\">plano diretor<\/a><\/span> <span style=\"color: #000000;\">deve definir as dimens\u00f5es dos lotes.<\/span><\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">Ou seja, todo parcelamento do solo deve obedecer a lei municipal a respeito do tema.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><span style=\"font-size: 24px; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #000000;\">Com o passar das d\u00e9cadas ap\u00f3s a cria\u00e7\u00e3o da lei do parcelamento do solo, o parcelamento do solo urbano se viu com o grande acumulo de lotes e apartamentos em<\/span> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/adenilsongiovanini.com.br\/blog\/loteamento-irregular-e-loteamento-clandestino\/\">situa\u00e7\u00e3o clandestina ou irregular<\/a><\/span><span style=\"color: #000000;\">.<\/span><\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">Este \u00e9 um problema que est\u00e1 presente em todas as classes sociais do pais. Temos im\u00f3veis em situa\u00e7\u00e3o irregular em favelas e tamb\u00e9m em condom\u00ednios de luxo. Isso quando n\u00e3o \u00e9 o condom\u00ednio como um todo que est\u00e1 em situa\u00e7\u00e3o irregular ou clandestina.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #000000;\">Para voc\u00ea ter uma ideia, dados do minist\u00e9rio do desenvolvimento regional mostram que atualmente<\/span> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.correiobraziliense.com.br\/app\/noticia\/brasil\/2019\/07\/28\/interna-brasil,774183\/imoveis-irregulares-no-brasil.shtml\">cerca de 50% dos mesmos encontram-se em situa\u00e7\u00e3o irregular<\/a><\/span><span style=\"color: #000000;\">.<\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Ou seja, atualmente temos algo no entorno de 30.000.000 de im\u00f3veis em situa\u00e7\u00e3o <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">irregular. <\/span><\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">Isso fez com que, com o tempo, surgissem enormes esfor\u00e7os na busca pela regulariza\u00e7\u00e3o dos im\u00f3veis que se encontram em situa\u00e7\u00e3o irregular.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #000000;\">Como consequ\u00eancia, no ano de 2009 foi aprovada a lei 11.977\/2009 (posteriormente alterada pela lei<\/span> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2011-2014\/2011\/Lei\/L12424.htm#art1\">12.424\/2011<\/a><\/span>). <span style=\"color: #000000;\">Lei esta que disp\u00f5e sobre o Programa Minha Casa, Minha Vida \u2013 PMCMV e sobre a regulariza\u00e7\u00e3o fundi\u00e1ria de assentamentos localizados em \u00e1reas urbanas.<\/span><\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif; color: #000000;\">Entre outras coisas, a lei 11.977\/2009 definiu em \u00e2mbito nacional as ZEIS (<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/planodiretor.mprs.mp.br\/arquivos\/vazios.pdf\">Zonas Especificas de Interesse Social<\/a><\/span>).<\/span><\/p>\n<p><span style=\"font-size: 20px;
